How many drinks does it take to add up to a DWI charge in the State of New York?

A person may ask this question a lot in the state of New York. Three categories of legal facts to consider may be:

  • If a person is under the age of 21, their (BAC) or blood alcohol content or concentration can only be .02%;
  • If an individual is 21 years of age or older, their (BAC) or blood alcohol content or concentration can only be .08%;
  • If the individual is a commercial driver of some kind, their (BAC) or blood alcohol content or concentration can only be .04%

One drink can equal:

  • One beer
  • One 3 oz. glass of wine
  • One shot or 1 oz. of hard liquor
The weight of a person is very relevant to how many drinks that they may enjoy before becoming legally drunk.

There are also 5 things that an individual should know when a police officer pulls them over for DWI’s or any other suspicious behavior:

  • A police officer must have probable cause to pull a person over;
  • Any accident or injury of some sort may be probable cause to launch an investigation;
  • If an officer pulls a person over without probable cause, a person can fight it with the correct legal criminal defense professional;
  • Bad behavior can justify probable cause;
  • Probable cause never justifies pretext stops to launch an investigation, so know your rights with a good criminal defense professional

There are also visual cues that the police officers watch for when they decide to pull a person over for a suspicious of guilt for a DWI. The National Highway Traffic Safety Administration (NHTSA) researchers have comprised a list of over 100 criminal cues that can predict blood alcohol concentrations (BAC) of 0.08% or greater. A reduction was performed on the list and the numbers were dropped down to 24 and these 24 criminal cues were further compressed into 4 main categories:

  • Problems with staying in the same traffic lane while driving;
  • Braking and speed issues and problems while driving;
  • Problems with Vigilance;
  • Problems with judgment calls

An experienced DWI Lawyer would be able to make a legal argument against the charges and allegations before a court. They could investigate the alcohol breath test, investigate the traffic cams and police reports, and search every legal avenue to prove their client's innocence in court or get a favorable plea deal for all parties.
